Terms & Conditions for Midwest Heritage SMS Program (Conversational)

Midwest Heritage Bank, FSB, Midwest Heritage Services, LLC (dba Midwest Heritage Insurance Services) and their affiliates (collectively “Midwest Heritage”) offer two-way text messaging to assist insurance customers and prospects with quoting, policy questions, and ongoing support (“Program”). This Program is conversational and intended for individualized service—not marketing or promotional messages. If we later offer marketing texts, we will obtain separate, appropriate consent.

You may enroll by checking the SMS box during a quote request. By enrolling, you confirm you are the subscriber or usual user of the mobile number provided. For any future marketing texts, we will request clear, written consent specific to Midwest Heritage. By enrolling in this Program, you (i) certify that you are at least eighteen (18) years old (or the age of majority in your state) and (ii) agree to these terms and conditions, which become effective upon your enrollment.

You can stop receiving messages for this Program at any time by texting STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to one of the following numbers: 913-548-0587; 515-416-9057; 913-548-0586; 515-416-9056; 515-309-4128; 515-333-4221; or 515-416-9058 (the “Midwest Heritage SMS Numbers”). After you send STOP, we may send a confirmation message and then no longer send messages for this Program unless you re-enroll. You acknowledge this consent is not a condition of purchase or service. You represent that you are the owner of the wireless device for which you have authorized enrollment in the Program and are responsible for messages sent from the device. You acknowledge that you must notify Midwest Heritage if your mobile phone number changes or if you no longer own the device assigned by your wireless carrier.

Message frequency varies based on your conversation with our team. Message and data rates may apply. Check your mobile plan for details. Wireless carriers are not liable for delayed or undelivered messages. Service may not be available on all carriers or in all areas.

SMS conversations may be logged and retained consistent with our legal, regulatory, and audit obligations for electronic communications. Insurance coverage cannot be bound, altered, or canceled via SMS. Policy changes, endorsements, bind requests, and cancellations require written confirmation from a licensed agent. Quotes are not guarantees of coverage; eligibility and underwriting apply.

You acknowledge that the Program is provided on an “as is” and “as available” basis and that we do not make any warranty or representation as to availability, usability, or fitness for a particular purpose. We do not warrant that any information provided in our Program is accurate, complete, reliable, current or error-free. We exclude all other implied terms and warranties, whether statutory or otherwise, relating to the Program. To the fullest extent permitted by applicable laws, we will not be liable to you for any claims, losses, demands, or damages of any kind whatsoever with respect to or connected to these terms and conditions or your use of the Program, including, without limitation, direct, indirect, incidental, or consequential losses or damages, whether it be in contract, tort, under any statute or otherwise (including, without limitation, for loss of revenue, loss of profits, loss or corruption of data and any other commercial or economic loss of any kind).

We handle your information per our Privacy Policy. Please do not send sensitive personal or financial data (e.g., full account numbers, SSNs, card numbers) by text. If such information is needed, we will direct you to a secure channel to provide that information to us.

You agree that (a) any and all disputes, claims, and causes of action arising out of or connected with the Program will be resolved individually, without resort to any form of class action; (b) to the fullest extent permitted by law, you waive any right to a jury trial in any action or other legal proceeding arising out of or relating to these terms and conditions or your use of the text message services; and (c) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  All issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions, or your and our rights and obligations shall be governed by the laws of the State of Iowa, without regard to conflicts of law principles or rules, and all proceedings shall take place in the District Court in and for Polk County, Iowa.
